Stage of relationship with the supplier at the time of the incident:
I have been exporting out of China and other countries for over 20 years. I am actually based in China and visited the offices of this supplier in Dongguan myself. We have had a number of orders with this supplier, they are just very sneaky and underhanded how they conduct their business.
The previous orders were also furniture, when furniture is imported to Australia it needs to have fumigation with certificates provided showing completion. The terms have always been FOB, one of the costs of FOB is the seller paying the costs of fumigation. The first time we bought 2 containers and went through these arguments with Asia Stock Lot, they also tried to supply poor quality “copy” documents of the fumigation certificate. To try to force us to pay all for original documents.
In this recent shipment, they tried the same provided “poor” quality “copy” document, we had to argue with the factory for 2 days to eventually get an acceptable “copy” document for import clearance.
We paid for the shipment in full, once our shipping agents had a full set of “copy” documents. We did not pay for fumigation as that was part of the FOB expense, or in the event, they thought we should have paid that, should have been stated on the PI.
This is a distributor/agent not to trust!!
Be very careful about understanding the terms of trade and the “games” these people play. Then if you pay them what they should be paid according to a PI contract. Be aware if you pay them less (but the amount that should be paid by the PI) they will then try to prevent the container being released. this then risks the costs of wharf storage or container Demurage.
