Stage of relationship with the supplier at the time of the incident:
Contracted TransCanada, sent in all our information, they gave us a quote in person. After confirming they will be sending their own people, no 3rd party (listed in an email by their Sales Manager, a 3rd party truck company showed up that was hired by TransCanada, they arrived more than 4 hrs later than scheduled, damaged our rental property, breached our contract by changing payment method the day before delivery by refusing CC payment and demanding only cash, and they are refusing to pay for our damaged wall, damaged queen sleigh bed, Samsung washing machine with pedestal, and other items.
I witnessed them dropping my furniture, they gave us 10 days to unpack and submit our damaged, then they are denying they had a contract with us, and that they caused the damaged. We have contacted the BBB in BC, Canada and now there is a case for mediation. They also came up with a miscellaneous charge of $800 stating because they had to unpack and repack the truck. We were to have a dedicated truck, we did not, they sent the wrong size truck. Our contract stated we had 5-weeks of free storage, and the Sales Manager stated we had 4 weeks free storage. This is messy. TransCanada is doing their best not to payout. They are offering us funds not close to what we are requesting, they stated we were the ones that hired TransAtlas, which is not true, that their Sales Manager gave us TransAtlas’s phone number, which is not true. TransCanada is listed with the Better Business Bureau/BBB, TransAtlas is not. The bottom line, we contracted with TransCanada, and they are liable for damages caused by their employees/contractor.
Be careful. Keep all your emails and correspondence.
