I have agreed with the seller to buy a bathtub.
The seller offered me that he would deliver the goods to a port in Europe for 350 USD. I asked if I could do the transport myself on a FOB basis. The seller informed me that transporting the bathtub to FOB Guangzhou will cost me an additional 100 USD. I agreed to these conditions. I received an invoice confirming the agreed conditions.
When the goods were ready for shipment, my agent contacted the seller to arrange delivery details for FOB. The seller refused to deliver the goods to FOB Guangzhou due to too high costs that he would have to bear. He demands that I cover additional port fees in FOB Guangzhou.
In accordance with international regulations under FOB terms the seller bears all costs and risks up to the point the goods are loaded on board the vessel. The seller’s responsibility does not end at that point unless the goods are “appropriated to the contract” that is, they are “clearly set aside or otherwise identified as the contract goods”. Therefore, FOB contract requires a seller to deliver goods on board a vessel that is to be designated by the buyer in a manner customary at the particular port. In this case, the seller must also arrange for export clearance. On the other hand, the buyer pays cost of marine freight transportation, bill of lading fees, insurance, unloading and transportation cost from the arrival port to destination.
Seller ignore these rules and refuses to deliver the goods. He also refuses to refund and cancel transaction. The seller claims that he only agreed to deliver the goods to the port, but he did not agree to bear the port costs. Of course, this is not true, which is confirmed by attached screenshots of correspondence and received documents.
The seller explicitly agreed to the terms of the FOB and refuses to perform the contract.
It seems to me that there is no good advice in this situation.
Ideally, payment for the goods should be made by credit card or PayPal. Then you could use the chargeback procedure. However, I have not yet met any seller from China who would agree to such a payment.
