The purchase was made through a broker in Norway.
The broker had been in contact with the supplier for more than a year via mail and had a really good impression.
Buyer’s specification was sent to Supplier which was signed and thus the basis for the contract.
The Supplier orderered an SGS report on Buyer’s request and approved the report before sending the berries.
The papers came through the bank, so Buyer paid for the berries in order to get the B/L to release the berries.
Upon arrival the berries were in poor condition. Buyer did not accept the product and left them in the container telling Seller to take it back. The Chinese Seller refused this. They pointed to the contract, saying they had delivered as promised. Also they made themselves unavailable.
The broker contacted SGS who found out that the contract was forged. Pictures were left out and even manipulated. Also quality descriptions were altered to adhere to Buyers spesifications.
